By installing or otherwise using this software product, you are agreeing to the following:

SOFTWARE LICENSE

  1. SOFTWARE APPLICATION USAGE
    1. Your Service Provider hereby grants to you a limited, personal, revocable, non-assignable, non- transferable, non-exclusive license to use the software application (which shall include future updates or upgrades made available to you from time to time provided you understand such updates or upgrades may be subject to additional terms) subject to the following obligations and restrictions:
      1. You may only use the application on one single registered mobile phone belonging to you or under your control. You will need to register separately each additional or replacement mobile phone.
      2. You may only use the application for the purpose of receiving mobile services and for no other purpose whatsoever.
      3. The application is licensed only to you for your personal use and you shall not assign, sub-license, lend, redistribute, or grant any rights of use or any other rights in respect of the application to any other person.
      4. You shall not copy or reproduce (except as expressly permitted by this License), decompile, reverse engineer, disassemble, attempt to derive the source code of, modify, or create derivative works in any way the whole or any part of the software application.
      5. You shall not use the application in any manner that could damage, disable, overburden, or impair the application (or any server or network connected or interfacing with such application) or interfere with any third party’s use and/or enjoyment of the application
      6. You shall not remove or tamper with any copyright notice attached to or contained within the software application and you acknowledge and agree that as between us and you, all ownership in the software application remains with us and you shall not acquire any right, title or interest in and to the application, whether by implication, estoppel, or otherwise, except for the limited rights set forth in this License.
      7. You shall not use, test or otherwise utilize the application in any manner for purposes of developing or implementing any method or software that is intended to monitor or interfere (including intercept data) with the functioning of the application (or any server or networks connected or interfacing with the application)
      8. You shall not intentionally interfere or circumvent the application’s security features.
      9. You also agree that you will not use the application for any purposes prohibited by United States law or applicable laws.
      10. On any termination of the mobile services, all rights granted to you in respect of the software application shall immediately cease.
      11. Any open source software that may be accompanying the application is provided to you under the terms of such open source license agreement and not under the terms of this License, and your Service Provider disclaims any liability with respect to any open source license provided, as stated below.
  2. SOFTWARE LICENSE TERMINATION
    1. The software license shall commence upon your acceptance of the software license or when you install the software application (whichever is first) and shall continue until terminated in accordance with the following clauses or otherwise in accordance with the software license.
    2. The software license will terminate automatically if you cancel the mobile services and/or uninstall the software application, or fail to comply with this License or the mobile services Terms and Conditions.
    3. Upon termination of the software license for any reason whatsoever, you must uninstall the software application and destroy all copies of the software application including all components of it in your possession or control.
  3. DISCLAIMER OF WARRANTY
    1. YOU ACKNOWLEDGE AND AGREE THAT USE OF THE APPLICATION, ACCOMPANYING OPEN SOURCE LICENSE, IF ANY, AND THE MOBILE SERVICES ARE PROVIDED "AS IS " AND "AS AVAILABLE", WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND, AND YOUR SERVICE PROVIDER AND ITS SUBSIDIARIES, AFFILIATES, EMPLOYEES, AGENTS, OFFICERS, AND DIRECTORS HEREBY DISCLAIM ALL WARRANTIES (EXPRESS, IMPLIED, OR STATUTORY) OF ANY KIND WITH RESPECT TO THE APPLICATION, ACCOMPANYING OPEN SOURCE LICENSE, IF ANY, AND MOBILE SERVICES, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, OF SATISFACTORY QUALITY, OF FITNESS FOR A PARTICULAR PURPOSE, OF ACCURACY, OF QUIET ENJOYMENT, AND OF NON- INFRINGEMENT OF THIRD PARTY RIGHTS. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES OR LIMITATIONS ON APPLICABLE STATUTORY RIGHTS OF A CONSUMER, SO THE ABOVE EXCLUSION AND LIMITATIONS MAY NOT APPLY TO YOU. YOUR SERVICE PROVIDER DOES NOT GUARANTEE THAT THE APPLICATION WILL BE COMPATIBLE WITH EVERY TYPE OF MOBILE PHONE. NOTWITHSTANDING ANYTHING IN THE FOREGOING, IN NO EVENT WILL THE LIABILITY OF YOUR SERVICE PROVIDER AND ITS RESPECTIVE SUBSIDIARIES, AFFILIATES, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS (REGARDLESS OF THE FORM OF ACTION, WHETHER IN CONTRACT, TORT, OR OTHERWISE) EXCEED $100.
  4. LIMITATION OF LIABILITY
    1. TO THE EXTENT NOT PROHIBITED BY LAW, IN NO EVENT WILL YOUR SERVICE PROVIDER BE LIABLE FOR ANY DAMAGES, INCLUDING WITHOUT LIMITATION DIRECT OR INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES, LOSSES OR EXPENSES ARISING FROM THE APPLICATION, ACCOMPANYING OPEN SOURCE LICENSE, IF ANY, OR THE MOBILE SERVICES OR USE THEREOF OR INABILITY TO USE BY ANY PARTY, OR IN CONNECTION WITH ANY FAILURE OF PERFORMANCE, ERROR, OMISSION, INTERRUPTION, DEFECT, DELAY IN OPERATION OR TRANSMISSION, COMPUTER VIRUS OR SYSTEM FAILURE, EVEN IF YOUR SERVICE PROVIDER, OR THEIR REPRESENTATIVES, ARE ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, LOSSES OR EXPENSES.
  5. EXPORT CONTROL
    1. You may not use or otherwise export or re-export the application except as authorized by United States law. In particular, but without limitation, the application may not be exported or re-exported (a) into any U.S. embargoed countries or (b) to anyone on the U.S. Treasury Department's list of Specially Designated Nationals or the U.S. Department of Commerce Denied Person's List or Entity List. By using the application, you represent and warrant that you are not located in any such country or on any such list.
